贈(zèng)與人對(duì)贈(zèng)與財(cái)產(chǎn)瑕疵的擔(dān)保責(zé)任分以下三種情況:1、贈(zèng)與合同為無(wú)償合同,故贈(zèng)與人原則上不承擔(dān)贈(zèng)與物的瑕疵責(zé)任損失。2、附義務(wù)的贈(zèng)與,贈(zèng)與的財(cái)產(chǎn)有瑕疵的,贈(zèng)與人在附義務(wù)的限度內(nèi)承擔(dān)與出賣人相同的擔(dān)保責(zé)任,這就是說(shuō),在贈(zèng)與合同中,所附帶的義務(wù)越多,贈(zèng)與人的財(cái)產(chǎn)瑕疵擔(dān)保責(zé)任就越大,反之,若所附義務(wù)越小,其瑕疵擔(dān)保責(zé)任就越小,贈(zèng)與人的瑕疵擔(dān)保責(zé)任與所附義務(wù)相當(dāng)。3、如果贈(zèng)與人明知贈(zèng)與財(cái)產(chǎn)有瑕疵,卻故意不告訴受贈(zèng)人;或者贈(zèng)與人向受贈(zèng)人明確保證贈(zèng)與財(cái)產(chǎn)無(wú)瑕疵,但贈(zèng)與財(cái)產(chǎn)卻有瑕疵,由此給受贈(zèng)人造成的損失,贈(zèng)與人得承擔(dān)損害賠償責(zé)任,從各國(guó)立法看,也大都規(guī)定了贈(zèng)與人故意不告知贈(zèng)與財(cái)產(chǎn)瑕疵的,應(yīng)負(fù)瑕疵擔(dān)保責(zé)任。

這里所說(shuō)的瑕疵包括質(zhì)量瑕疵和權(quán)利瑕疵。一般情況下,贈(zèng)與的財(cái)產(chǎn)有瑕疵的,贈(zèng)與人不承擔(dān)責(zé)任,這主要是基于贈(zèng)與合同的單務(wù)性質(zhì)和無(wú)償性質(zhì)所決定的。 《民法典》規(guī)定了兩種例外:附義務(wù)的贈(zèng)與,贈(zèng)與的財(cái)產(chǎn)有瑕疵的,贈(zèng)與人在附義務(wù)的限度內(nèi)承擔(dān)與出賣人相同的責(zé)任;贈(zèng)與人故意不告知瑕疵或者保證無(wú)瑕疵,造成受贈(zèng)人損失的,應(yīng)當(dāng)承擔(dān)損害賠償責(zé)任。贈(zèng)與人的瑕疵擔(dān)保責(zé)任內(nèi)容僅以賠償受贈(zèng)人因標(biāo)的物的權(quán)利瑕疵或物的瑕疵所受到的損害為限。
